in which situation would rather have a jury than a judge?

- When you don't have the law on your side (or entirely on your side) but you can make an emotional appeal to a jury.
- When the legal definition of your actions would find you guilty, but the jury might have sympathy for the "human" side of your actions or the circumstances. For instance, a domestic violence victim finally murdering their spouse after years of abuse.
- Having worked for attorneys its almost considered malpractice to fail to ask for a jury trial in almost any case. Exceptions are cases where there is strong evidence that the defendant is legally insane when the offense was committed. Also, most judges are old white guys. If a Civil case has a plaintiff who is an old white guy, especially one who is an attorney, then the plaintiff might do better with a trial before a judge. The last exception is in civil matters where the law is extremely complex to the point where a jury would be hard pressed to understand what the case was even about. I am not a lawyer.
