Do you have to actually possess property to be guilty of receiving stolen property?

  1. Not necessarily; you could have received it and then sold it.
  2. The answer is no.... Just proof that the exchange occurred. For instance, if an undercover officer sold property to you that you knew was stolen, then you sell the property, then you can still be charged and convicted in many states.
  3. Not in my state, but the laws do vary from state to state. You need to ask a lawyer in your area.
