Is an engineering or science degree necessary to practice intellectual property law? I'm a first year law student with a background in web development. Someone suing me over my domain name sayings its infringeing, am I liable up to $100k by the "Lanham act"? If you are an intellectual property lawyer who deals with trademarks infringement you should be able to answer this. I will use KMart and Walmart for examples in my scenario A company owns a trademark on ("WALMART"), so they own WALMART.com. I purchased a domain called KMART.com. They want to sue me because they say the word "MART" in my domain name infringes their federal trademark of ("WALMART"). My business would pertain to a similar service as theirs. So the question is, is my domain trade mark infringing? Am I liable for any statutory fines? They keep threatening me that I am liable up to $100k by the Lanham act. I have not made any money off of my domain, it merely had a home page. What is the worst I have to worry about? I could only imagine injunction, but then what would the statutory fines be for? In biotech, the stakes will get even higher...? It seems that much money can be made by finding organisms in nature (medicinal plants in undiscovered parts of rain forests, for example), and then splicing the genes of a given genetic attribute (of organism A) into organism B (transgenics). Furthermore, although we know the genetic sequence of many organism, we still do not actually know what is the actual biological function of many of the encoded proteins (with potentially patentable attributes). Given that a transgenic organism (one that has desirable transgenic attributes) can be worthy of patent rights, and given that the source of those potentially desirable genes are essentially genomic information, then doesn't it seem that in the future biotech firms will fight over there pieces of sequence information as type of intellectual property? It seems especially likely when one needs (say a competing biotech firm) the genomic information in order to understand the full panorama of proteins (the first step in determining the patenable worthiness/justification and attributes of a genetic sequence). *** Many things that were entrusted to the US Supreme Court only latter to become completely reversed, one small example: Private property rights: The US Supreme Court (Antonin Scalia a few years ago) mandated that those particular house owners sell their property (Waterfront property in New England, at the developer’s price) to that developer…and the justification? To paraphrase Scalia, “the needs of the community as a whole where better met by allowing that property to be developed, and in the process many more individuals found housing, than were met by those house owners being allowed to keep their property”. BTW this is in contrast to the GOVERNMENT taking a citizen’s property for the good of the country (National highway system, for example). Also, in the early 1980’s an American lawyer discovered a loophole in the United Nations charter that agreed that the Earth’s moon cannot be claimed…So with that loop hole, this lawyer claimed the moon and made millions selling plots of moon territory to people. *** Here’s my point, Just because something seems like “common sense” or “sacred” to our sensibilities really means little or nothing to the rich & powerful interest, AND those politically-connected Supreme Court appointees will eventually “interpret” legality to favor “progress” (the rich & powerful). *** Question: Doesn’t it seem inevitable that the Supreme Court will eventually come to the conclusion that organismal genetic information should be treated like intellectual property to be sold to the highest bidder (who would then make the most of the information in a profitable way by returning a product of market value, which is the reason why that firm WAS the highest bidder)??? Before you answer, consider the following: Also, many firms could participate from one organism genetic sequence if the code is parceled out to different firms (like land, for example). And so, by “parceling out” (dividing the genetic sequence into intellectual property segments) many firms can participate in the unraveling of an organisms transgenic value (instead of just one) AND with the incentive that each firm will have patent protection for the transgenic products they do market, within their respective legally allotted sequences.
Why was someone arrested over the TV Links website? As reported in the Guardian, last Thursday a 26-year-old Cheltenham man was arrested and the site, tv-links.co.uk, was closed . According to the Gloucester police, the arrest was carried out for alleged violations of Section 92 of the Trade Marks Act. The man was not charged and the case remains under investigation, says Eddy Leviten of the Federation Against Copyright Theft. He likened the activity of TV Links to someone who advertises a car that is not theirs. "The main issue is that the original material is stolen," he alleges. TV Links was collecting links to movies such as the new Nancy Drew film that were allegedly illegally recorded in the cinema and then hosted on Chinese websites, he said. The federation is pursuing the websites that host the material, but it is difficult to pursue sites not under English jurisdiction. The law governing the case is not clear. Section 92 of the Trade Marks Act is frequently used by the federation to pursue illegal CD and DVD copiers, but lawyers said the act relates to goods and has not been applied to audio-visual material that is not on a physical disc or other storage media. Under US law and the MGM v Grokster case in 2005, the US Supreme Court found Grokster liable for "inducement", encouraging others to infringe copyright. However, English law does not recognise inducement. But this case turns on the issue of linking and the Trade Marks Act. Out-law.com, the blog of international law firm Pinsent Mason says: "It is not clear how the provision of links will be prosecuted as a criminal offence." Alex, writing on the Impact blog from UK law firm Freeth Cartwright, agrees. "On the facts that we know so far, it is difficult to see how the providing of links to infringing copies of TV shows gives rise to a civil or criminal liability under UK law," he said. The Trade Marks Act may not fit the alleged crime. "The Trade Marks Act makes the unauthorised use of trade marks in relation to goods an offence; but this is a law that was written to catch counterfeit goods," said Kim Walker, head of intellectual property at Pinsent Masons. "The provision of links is surely a service, not a sale of goods. It seems an unlikely way to deal with the problem." Alex at Freeth Cartwright says: "Such links might constitute an offence under other parts of copyright law (distributing infringing copies or communicating copies to the public in the course of business), but it is again difficult to see how the facts meet these offences."
Discouraged become lawyer? I'm in college majoring in Political Science and minoring in History. I make good grades, I enjoy it and I'm good at it. However, it would appear Poli Sci is not a particularly valuable degree. I've been told I'd make a great attorney and I have an interest in intellectual property & technology law. But everyone tells me law school is very stressful/difficult and law is a very stressful profession. So I'm kinda discouraged/depressed as to what to do. I'm told lawyers aren't particularly happy people and that the practice of law is very stressful and a lot of lawyers become alcoholics/addicts of some kind to cope. Plus, law school is very expensive so if I take the risk it'll be huge debt. Since the degree I'll so have (BS in Poli Sci) is basically worthless I'm kinda depressed about my future. Yeah, a lot of people tell me I need a tech degree to do patents or IP. I guess I should find another interest.

Is there any lawyer out there willing to sue California Department of Vocational Rehabilitation pro bono? The mandatory exemplary damages payout is cumulatively atstronomical because several state employees broke several state & federal laws. I really think that a good lawyer can convince a court to prosecute criminal charges against these people. I'm talking: Gross Negligence; Proffessional Negligence; Indifference To The Facts; Destroying Evidence of a Crime; Obstructing Evidence of a Crime; Misrepresenting Evidence; Misrepresenting Information; Fraud, Libel and Slander. But there's more, according to a California lawbook I read, it all amounts to OPPRESSION! Wow! This can make it to the U.S. Supreme Court! This may be the first ever charge of Theft of Intellectual Property tied to Discrimiation on The Basis of Disability, The Disability of Mental Illness! So, state employees at rehab think they can steal some crazy guy's inventions and nobody will ever beleive him since they've cleaned up their tracks all the way up to Sacramento and the Board of Appeals' Fair Hearing.
I am an LLM student doing IP but I want to become an investment banker- do i have the right skills? Basically I am in a dilemma; for my undergrad I studied both a science (Chemistry) and law, and graduated with honors, from a top five University in the United Kingdom I am now doing a advanced law degree (LL.M) in Intellectual Property here in states at a top 10 Law school, however I have since become extremely disillusioned with following law as a career path. I am now wanting to switch to finance, but would rather be an investment banker over a corporate lawyer any day of the week :-) Also I am unable to take any corporate law classes as I am stuck on the “IP” track. I think I have the right quantitative skills, by virtue of my chemistry degree but would I be marketable to many of the big banks? i.e. (Morgan Stanley, Merril Lynch, Goldman etc) I am still young (23 just turned) and extremely ambitious- do I have what it takes? What are your thoughts? Thanks
